These Terms include a binding individual arbitration clause and a class action waiver in §17. You and ZoneIN agree to resolve most disputes through arbitration on an individual basis instead of through the courts or as part of a class. You have 30 days from first agreeing to these Terms to opt out by emailing support@mail.zoneinhq.com with subject "Arbitration Opt-Out". See §17 for the full terms and the carve-outs (small claims, IP injunctions, and anything law forbids from being arbitrated).
1 · What ZoneIN is
ZoneIN is a fan-operated sports community platform. We are not affiliated with, endorsed by, sponsored by, or licensed by any team, league, conference, school, athlete, or official sports organization. Every team page, conference page, and community on ZoneIN is built and run by fans. Team and league names are used nominatively — solely to identify the subject of fan discussion — under longstanding fair-use principles.
ZoneIN is operated by Ventiq LLC. In these Terms, "ZoneIN," "we," "us," and "our" refer to Ventiq LLC, the operator of the ZoneIN platform.
2 · Your account
You must be at least 13 years old. You're responsible for the activity on your account, for keeping your sign-in method secure, and for everything you post. You may delete your account at any time from Settings; we honor the deletion within 30 days, subject to lawful retention obligations (e.g. moderation logs, verification records, and financial records).
3 · Acceptable use
You agree not to:
- Post content that is illegal, harassing, defamatory, threatening, hateful, or sexually exploitative of minors.
- Target real individuals on the Banter Boards or anywhere else on ZoneIN. Talk trash about teams, takes, plays, calls, and coaching decisions — not about specific athletes, referees, opposing fans, journalists, or any other identifiable person by name, image, or unique descriptor. Personal attacks, doxxing, name-calling directed at an individual, threats, and ridicule of an athlete's family, medical history, or personal life are removable on sight and may result in immediate account termination.
- Impersonate another person, team, league, school, athlete, or official organization.
- Use ZoneIN to scrape, mirror, or republish another fan's content outside the platform without their permission.
- Attempt to disrupt the service, bypass moderation, or evade a ban / fan-flag.
- Use the platform to send spam, run automated scrapers, or manipulate engagement metrics.
- Upload imagery (profile pictures, banners, custom emojis, custom stickers) you don't have the right to use, or that infringes a third party's trademark or copyright.
- Misrepresent your authority to verify or operate a team page on behalf of an organization you don't legitimately represent.
We can hide, lock, or remove any content and suspend or terminate any account that violates these rules. Repeat or severe violations are permanent. Reports get reviewed within 24 hours; flagrant violations (doxxing, threats, sexual content involving minors) get an immediate hold pending review.
4 · Your content
You keep ownership of everything you post on ZoneIN — your threads, replies, comments, video uploads, Zones, custom emoji submissions, and uploaded imagery. By posting or uploading, you grant us a worldwide, non-exclusive, royalty-free license to host, display, and surface that content within the platform (and in necessary backups / search indexes) for as long as your account is active. Delete your content or your account and the license ends, subject to residual copies in backups that age out on a normal schedule.
You represent that everything you post is yours to post — that you own it, are licensed to share it, or it falls under fair use. When you upload an image (avatar, profile banner, custom emoji, custom sticker) the upload UI asks you to confirm you have the right to use the asset; that confirmation forms part of these Terms.
5 · Embedded content & third-party links
ZoneIN includes tools (the Web Embed tile, video attachments, link posts, RSS aggregation) that surface content from third-party sites inside ZoneIN's UI. You — not ZoneIN — choose the URLs that go into a Web Embed or any other user-configured embed.By adding a URL or link, you represent that you have the right to embed or share that URL and that doing so doesn't violate the source site's terms.
Embeds are rendered client-side as standard iframes pointing at the source. ZoneIN does not cache, proxy, transform, or claim ownership over embedded content. Each embedded site enforces its own embedding policy via standard browser headers; ZoneIN respects those headers and shows a fallback link when a site refuses to be embedded.
Aggregated news items on team and conference pages come from publicly-published RSS feeds. We display title, excerpt, source attribution, and a link to the source; full articles always open on the publisher's own site.
6 · Trademarks, team names, and fan use
Team, league, conference, and school names referenced on ZoneIN are the trademarks of their respective owners. We use them nominatively — to identify the subject of fan discussion — without any claim of endorsement or affiliation. We do not display, host, or sell merchandise bearing official logos, mascots, wordmarks, or other licensed brand assets.
If you're an authorized representative of a team or organization and believe a specific community misuses your marks, contact us through the takedown process below. We respond within two business days and act in good faith.
7 · Team verification & the Brand Page Agreement
NCAA schools (and select pro organizations) may apply to verify their team page on ZoneIN. Verification unlocks branded controls (logo upload, banner customization, deal listings, NIL ledger visibility, payout routing) and replaces the fan-operated badge with a verified badge.
To verify, an authorized representative must accept the Brand Page Agreement, a separate click-wrap document. By accepting that agreement, you represent that you are authorized to act on behalf of the organization and that you have read and agree to its terms. We record your IP address, browser user-agent, and timestamp as proof of consent.
8 · NIL Hub, deal listings, and the NIL ledger
ZoneIN's NIL Hub surfaces publicly-available information about name-image-likeness deals involving athletes and teams. Deal listings are curated from public sources or submitted by verified school representatives. ZoneIN is not a party to any NIL deal, contract, or transaction displayed on the platform. We do not negotiate, broker, sign, or distribute deal terms.
For verified NCAA schools, ZoneIN routes a share of subscription revenue and affiliate commission (the "NIL share") to the school's designated NIL collective entity via Stripe Connect. The current split is published on the school's NIL Hub page and may be updated; the rate in effect at the time revenue accrues is the rate that applies. NIL share routes only to the school's collective entity, never to individual athletes — the collective handles redistribution under its own contracts.
NIL ledger accrual begins automatically for every NCAA team page regardless of verification status; visibility, payout, and per-team customization unlock once the school verifies.
Tax treatment. Neither a Team+ subscription nor any NIL contribution made through ZoneIN is a tax-deductible charitable donation where you receive features or benefits in return, regardless of the recipient's tax status. The recipient entity — not ZoneIN — is responsible for distributing funds to athletes and for issuing any athlete tax forms. 9 · Tickets & store — affiliate disclosure
ZoneIN displays tickets and merchandise from third-party vendors (e.g. SeatGeek for tickets; Shopify-based store vendors for merch). ZoneIN does not sell tickets or merchandise. Every purchase happens on the vendor's own site or hosted checkout. The vendor handles payment, shipping, fulfillment, refunds, chargebacks, and customer service for the transaction.
We earn an affiliate commission on qualifying purchases made through our outbound links. For NCAA team pages, a share of that commission routes to the school's NIL ledger; for pro team pages, the commission is retained by ZoneIN. Affiliate relationships do not influence which games or products we display.
10 · Store vendors
Approved store vendors connect their inventory to ZoneIN via the Vendor Portal. By applying as a vendor, you agree that:
- You are the authorized operator of the store you are connecting and have all rights necessary to display the listed products.
- You are solely responsible for product fulfillment, shipping, returns, taxes, and customer service for orders placed by ZoneIN users.
- You will honor the commission rate agreed to during vendor approval, paid through your platform's standard affiliate flow.
- You will not list merchandise that infringes a third party's trademark or copyright, including official team or league marks you are not licensed to sell.
- ZoneIN may suspend or remove your storefront for non-compliance with these terms or with the Vendor Portal's additional policies.
11 · Subscriptions & paid features
ZoneIN offers two subscription products:
- ZoneIN+ — a site-wide subscription that removes ads and unlocks cosmetic features (premium themes, frames, profile marks, cursors, custom flair, etc.). $4.99 per month or $39.99 per year.
- Team+ — a per-team subscription that supports a specific community and unlocks team-scoped fan customization (premium stickers, VIP-lane chat in live game threads, founding-sub badge for early subscribers, etc.). $4.99 per month per team. For NCAA team pages, 25% of each Team+ subscription is routed to the school's NIL revenue share. A Team+ subscription is a purchase of platform features, not a charitable donation, and is not tax-deductible — even where a portion is routed to a 501(c)(3) recipient.
Both subscriptions auto-renew until cancelled. You may cancel at any time from Settings or via the Stripe customer portal; cancellation takes effect at the end of the current billing period. We do not prorate refunds for partial periods. We do not provide refunds for previously charged periods except where required by law or to correct an obvious billing error.
Founding-member badges, individual cosmetic shop items, and other paid features carry pricing and any specific terms presented at checkout. We do not sell merchandise, jerseys, tickets, or any licensed team product — everything paid directly on ZoneIN is a ZoneIN-internal feature (subscription, badge, theme, flair, sticker).
12 · Copyright & takedown (DMCA)
ZoneIN complies with the Digital Millennium Copyright Act. If you believe content posted on ZoneIN infringes your copyright, send a DMCA notice to support@ventiqinator.com with the subject line "DMCA Notice", including: a description of the work, the URL of the infringing content on ZoneIN, your contact info, a good-faith statement that the use isn't authorized, a statement under penalty of perjury that your notice is accurate, and your physical or electronic signature.
We process valid notices within 48 hours during normal business days. Repeat infringers lose posting privileges; serial offenders lose their account. Counter-notices follow the standard 17 U.S.C. §512(g) procedure.
13 · Disclaimers
ZoneIN is provided "as is" and "as available." We do not warrant that the service will be uninterrupted, error-free, or that any specific community will reach the unlock threshold. Aggregated news, embedded third-party content, NIL deal listings, and ticket / store inventory reflect the views and policies of their sources, not ZoneIN.
14 · Limitation of liability
To the maximum extent permitted by law, ZoneIN, its operators, and contributors are not liable for indirect, incidental, consequential, or punitive damages arising from your use of the service. Aggregate liability for any direct damages is limited to the greater of $50 or the total amount you paid to ZoneIN in the 12 months preceding the claim.
15 · Indemnification
You agree to indemnify and hold ZoneIN harmless from claims arising out of content you post, URLs you embed, listings you submit as a verified team representative or vendor, or your violation of these Terms — including reasonable attorneys' fees, where permitted by law.
16 · Changes to these Terms
We may update these Terms. Material changes will be announced in-app and the "Effective" date above will move. Continued use after a change is acceptance of the updated Terms.
17 · Governing law, arbitration & class action waiver
These Terms are governed by the laws of the State of Utah, USA, without regard to conflict-of-laws principles. The Federal Arbitration Act (9 U.S.C. §1 et seq.) governs the interpretation and enforcement of §17.2 through §17.8 below.
17.1 · Informal resolution first. Before filing a formal claim, you agree to first contact us at support@mail.zoneinhq.com with subject "Dispute Notice" and a brief description of the issue. Most disputes resolve within 30 days of good-faith back-and-forth, and neither side may begin formal arbitration until 30 days have passed from a Dispute Notice.
17.2 · Binding individual arbitration. If we can't resolve a dispute informally, you and ZoneIN agree that any dispute, claim, or controversy arising out of or relating to these Terms, your use of ZoneIN, or any ZoneIN service (a "Dispute") will be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules in effect at the time of arbitration. The arbitrator's decision is final and enforceable in any court of competent jurisdiction. The arbitration will be conducted in English. The seat of arbitration is Utah County, Utah, USA, except that you may request a telephone or video hearing if travel would be a hardship.
17.3 · Class action waiver. You and ZoneIN agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate or join claims of multiple persons, and may not preside over any form of representative or class proceeding. If a court or arbitrator finds the class action waiver in this §17.3 unenforceable as to any claim, that claim alone will proceed in a court of competent jurisdiction, and the remainder of §17 will remain in full force.
17.4 · Carve-outs. The arbitration agreement above does not apply to:
- claims brought by either party in small claims court, so long as the claim stays in small claims and is brought in your individual capacity;
- claims for injunctive or other equitable relief to stop unauthorized use of, or infringement of, intellectual property (trademark, copyright, trade secret), which either party may bring in a court of competent jurisdiction;
- any other claim, relief, or party that applicable law prohibits from being arbitrated or from being subject to a class action waiver.
17.5 · Opt-out. You may opt out of the arbitration agreement and class action waiver in §17.2 and §17.3 by sending notice to support@mail.zoneinhq.com with subject "Arbitration Opt-Out" within 30 days of first agreeing to these Terms (for new users), or within 30 days of the effective date of this clause (for users who agreed to earlier versions of these Terms). The notice must include your full name, the email address associated with your ZoneIN account, and a clear statement that you wish to opt out of §17's arbitration and class action provisions. Opting out won't affect any other part of these Terms or your use of ZoneIN.
17.6 · Costs. For Disputes where you seek US$10,000 or less in damages and your claim is non-frivolous, ZoneIN will pay all AAA filing and administrative fees as required by AAA Consumer Rules. For higher-value claims, costs follow the AAA Consumer Rules.
17.7 · Forum for non-arbitrable matters. For claims that are not subject to arbitration under this §17 (small claims, equitable IP relief, claims by opted-out users, or where law forbids arbitration), the state and federal courts in Utah County, Utah, USA have exclusive jurisdiction. You and ZoneIN consent to the personal jurisdiction of those courts and waive any objection to venue.
17.8 · Severability. If any part of this §17 is found unenforceable, the rest of §17 stays in effect. If §17.3 (class action waiver) is found unenforceable as to a particular claim or remedy, that claim or remedy alone proceeds in court while all other claims continue in individual arbitration under §17.2.
